This petition seeks to challenge the order of the competent authority to proceed with application under section 11(3) of the Maharashtra Ownership Flats Act without opponent no.4 being served with full set of application and annexures.

This petition can be conveniently disposed of finally in view of the fact that Mr. Rayrikar, learned AGP appearing for respondent no.1 states on instructions, that the competent authority will provide full set of the application and annexures filed by respondent no.2 - applicant on 30th October, 2015 against payment of the copying charges. Accordingly, respondent no.1 is directed to handover full set of documents on 30th October,

Mr. Wassudev, learned counsel for the petitioner undertakes to file reply on or before 10th November, 2015. The competent authority may then proceed to hear the matter.
