DATED:- 26th MARCH, 2024 PC :- 1) Heard the learned Counsel for the parties.

2) The learned APP, on instructions, submits that seven witnesses have till date been examined and prosecution proposes to examine two more witnesses.

3) In view of aforesaid statement, the learned Counsel for the applicant seeks leave to withdraw the application. 4) The learned Counsel further submits that the Supreme Court by an order dated 4th March, 2022 had directed that the trial shall proceed expeditiously. The applicant has been in custody since four years and nine months and, therefore, the 1/2

47-BA-2975-23.DOC learned Special Court be directed to conclude the trial expeditiously.

5) Since seven witnesses have already been examined and the trial has reached an advanced stage pursuant to the directions of the Supreme Court, it may be expedient to request the learned Special Judge to conclude the trial in Special Case No. 172 of 2020 as expeditiously as possible and preferably within a period of four months from the next scheduled date of the Special Case.

6) The application stands disposed.
