Though the respondents are duly served no one appeared on behalf of them when the matter called out. 3.
By this Civil Application, applicant is seeking condonation of 174 days delay in filing First Appeal challenging the judgment and award dated 01.01.2010 passed by Reference Court in Land Acquisition Reference No. 378 of 2002. 4.
Considering the submissions made by learned Counsel for the applicant, averments made in civil application, I am satisfied that the applicant has made out case for allowing this Civil Application. Hence, following order :- S.C.Magar
924.caf.2044.2016.doc a) Civil Application is allowed in terms of prayer clause (b) which reads thus :- "(b) that this Hon'ble Court be pleased to condone 174 days of delay in filing above mentioned First Appeal against the Judgment and Award dated 01.01.2010 passed by the Learned Civil Judge, Senior Division, Barshi, Solapur in Land Acquisition Reference No. 378 of 2002;"
b) Civil Application stands disposed of accordingly. c) No order as to costs.
