The above petition has been adjourned from time to time at the request of the learned APP so as to take instructions as regards registering the F.I.R. at the behest of the Petitioner herein. The gravamen of the allegations of the Petitioner is that the accused has by various methods of forgery, impersonation etc. cheated him to the tune of Rs.4.87 Crores.

2/3 Today, when the above petition is taken up for hearing. The learned APP, Mr. Yagnik states that the substance of the grievance of the Petitioner has been made a part of the charge-sheet filed in respect of another F.I.R., which has been registered at the behest of the Mahanagar Co-operative Bank Limited. Suffice, it would be to state that the substance of the allegations of the bank is as regards defrauding of the said bank by the main accused. We have perused the charge-sheet and the substance of the allegations of the Petitioner, which has made part of the charge-sheet. We are not satisfied with the manner in which the Petitioner's case has been dealt with. We are of the view that a separate F.I.R. ought to have been registered by the Nigdi Police, which has yet not been done by the Nigdi Police.

This is on the ground that the substance of the allegations of the Petitioner are made part of the charge-sheet, which has been filed in the earlier F.I.R. We accordingly direct the Petitioner to approach the Nigdi Police Station on 28th March, 2018 for the said purpose and appear before Shri.

3/3 Senior Police Inspector, Nigdi Police Station, who would do the needful. The petition is accordingly disposed of. For compliance, we place the matter on 9th April 2018.
