Applicant is seeking his enlargement on bail in Crime No.100 of 2019 registered with Kasarvadavali Police Station for the ofences punishable under Sections 307, 326, 143, 147, 148, 149 427 read with Section 34 of the Indian Penal Code, 1860 ('IPC' for short). It appears, the applicant and the co-accused under the wrong information that injured was one of the persons whom they wanted to assault, allegedly Shivgan 1/4
inflicted blows through sickle on his leg. The injured sustained four injuries including the grievous injury that was inflicted on the left leg. Other injuries found and noted were simple in nature. Thereafter, a Complaint was fled against unknown persons, however, in the test identifcation parade, applicant was identifed by the injured complainant. Furthermore, statements of the eye witnesses also admit the presence of the applicant on the spot. However, no particular role has been attributed to the applicant nor he was armed with any weapon. Applicant is in custody since 11th April, 2019. Investigation in this case is over. In view of the statements of the eye witnesses and particularly of one Jitu Anil Gangurde and also in view of the injury certifcates relied upon by the prosecution, case is made out for releasing the applicant on bail. Prosecution has not brought on record any criminal antecedents against this applicant. In view of this, application is allowed. Hence, the Shivgan 2/4
following order:
ORDER
(i) The applicant be enlarged on bail in Crime No.100 of 2019 registered with Kasarvadavali police station, on executing PR Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount;
(ii) The applicant shall attend the concerned Police Station on the frst and fourth Monday of every month between 11:00 a.m. to 1:00 noon till the charge is framed; (iii) The applicant shall inform his latest place of residence and contact number within two weeks from the date of his release to the Investigating Ofcer of the concerned Police Station;
(iv) The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case;
The application is accordingly disposed of.
It is made clear that observations made hereinabove be construed as expression of opinion only for the purpose Shivgan 3/4
of granting bail and the same shall not in any way influence the trial in other proceedings.
