P.C.:- This is an application under Section 439 (2) of Cr.P.C. for cancellation of bail granted to Respondent No.1 vide order dated 07/09/2015 in C.R. No.I 400 of 2015.

Heard Mr. Kishor Patil, learned counsel for the Applicant and Mr. S.V. Gavand, learned APP for the Respondent -State. Perused the records.

By order dated 7thSeptember, 2015 the Applicant was ordered to be released on bail and he was directed to attend the police station on the Monday between 11.00 to 1.00 p.m. till fling of the charge sheet or further order. Learned counsel for the Applicant states that the 1/2

Megha 6_appln_706_2015.doc report dated 29/09/2015 submitted by API, Economic Ofences Wing, Navi Mumbai indicates that the Applicant had not reported to the police on 14/09/2015, 21/09/2015 and 28/09/2015. The records indicate that subsequent to the said application, charge sheet has been fled. 4.

Learned APP states that charge has been framed and that the matter is pending trial. He states that on 7/3/2021, 22/3/2021, 28/4/2021 and 14/5/2021 the matter was adjourned for settlement /compromise. Considering the fact that the charge sheet has now been fled and that the Applicant has been appearing before the Trial Court and that he has not misused the liberty, the application stands dismissed.
