The applicant is arrested on 13th February, 2017 for offences punishable under Section 307 of IPC. Learned APP on instructions from the officer present in the Court submitted that the trial has already commenced and four witnesses are examined. The prosecution proposes to examine about 10 more witnesses. 2.

Learned advocate for the applicant submitted that the complainant/injured has not been examined and he is not traceable. Considering the fact that the applicant is in custody from 13th February, 2017 and that the case has already commenced, trial Court shall make an endeavor to conclude the trial within a period of six months. In the event, trial is not concluded within a period of six months, the applicant will be at liberty to prefer application for bail. Application stands disposed of accordingly.
