Prima facie, it is seen that agreement dated 14/04/2015 cancelling the earlier agreements was lost sight of the learned trial Court while deciding the complaint for the offence punishable under Section 138 of the Negotiable Instruments Act, 1881. Similarly, undisputed position emerging on record from statement of the accused under Section 313 of the Code of Criminal Procedure was also lost sight of while dismissing the complaint.
