The Learned Counsel for the Applicant Mr. Deshpande states that the above Civil Application was filed on the premise that the Respondentwife is not complying with the consent terms in as much as she was putting forward conditions in respect of transfer of the flat in question, which were not part of the consent terms. However, the Learned Counsel states that the matter is now resolved and in the next few days the draft of the Sale Deed would be exchanged between the parties, hence the cause for filing the above Civil Application according to him no more survives. In view of what has been stated by the Learned Counsel Mr. Deshpande, the above Civil Application is disposed of as having turned infructuous.
