1) Heard. This is an application under section 438 of the Code of Criminal Procedure, 1973. Applicant herein is apprehending his arrest in crime no. 106 of 2016 registered at Lasalgaon Police Station for offence punishable under sections 323, 324, 395, 504, 506 r/w 34 of the Indian Penal Code. 2) Upon perusal of papers of investigation it appears that applicant happens to be almost 78 years old. The co-accused have been granted prearrest bail vide order dated 17/11/2016. It happens to be a case of cross complaint. In view of this, applicant also deserves pre-arerst bail. It is made ism

2 30.1872.16 aba clear that observations made herein above are restricted to an application under section 438 of the Code of Criminal Procedure, 1973 and shall not be considered for quashing of F.I.R., discharge application or at the time of trial.

O R D E R

(i) Application is allowed.

(ii) In the event of arrest, applicant be enlarged on bail on furnishing P.R. bond in the sum of Rs. 25,000/- with one or more sureties in the like amount. (iii) Applicant shall report to the concerned police station as and when called.
