Heard learned advocate for the applicant and learned APP, for the State.

The applicant before this Court is an accused who is subsequently added being a Director of one Shivjeet Mudra Multistate Credit Co-operative Society Limited. The informant lodged a report on 08.02.2019 that she happens to be a member of Women' s Bachat Group along with other 23 women. The amount of Women' s Bachat Group was deposited before Shivaji Success Private Limited having account in IDBI Bank. Thereafter, the main accused established the Society namely Shivjeet Mudra Multistate Credit Co-operative Society Limited. After establishment of that Society, the amount collected by the ladies was deposited with the said Society. Total amount of Rs.
55,200/- from Women's group was deposited and the same was not returned on asking. On this complaint, the offences came to be registered against Shivaji Tukaram Dhamdhere and Mandarani Shivaji Dhamdhere on 08.02.2019 with Baramati Police Station bearing C.R No. 138/2019 for the offence punishable under Sections 420, 406, 467, 468, 471, 409 r/w 34 of the Indian Penal Code ("IPC", for short) and under Sections 3 and 4 of Maharashtra Protections Of Interest of Depositors ("MPID", for short). During the investigation the name of the applicant revealed and she came to be added as accused. This Court by order dated 22nd December 2021 protected the applicant on a condition of attending the concerned police station as and when called by the IO.

Learned advocate for the applicant submits that this applicant was not looking to day to day affairs of the society. She was nominal Director. He further submits that this Court had already granted bail to one Ashwini Ashok Dhamdhere by allowing Bail Application No.2206 of 2019 by order dated 16th August 2019. Another accused namely Ashok Tukaram Dhamdhere is also granted bail by this Court in Bail Application No. 2984 of 2019 by order dated 6th February 2020. He further submits that it is 4 years of lodging of the FIR, there is no complaint against the applicant of causing interference with the investigation. She has attended the police station as and when required. There is no much information available with her. No purpose would be served by custodial interrogation. Learned advocate thus prays for allowing the application.

Learned APP informs that the applicant has attended the police station as and when required. Charge-sheet is also filed on
28.06.2019.

On considering above, this Court finds that since the investigation is over and charge-sheet is also filed, application deserves to be allowed. Hence, the following order:-
ORDER
(a) Application is allowed.
(b) In the event of arrest, the applicant shall be released on bail in connection with C.R. No.138/2019 registered with Baramati Police Station for the offence punishable under sections 420, 406, 467, 471, 409 r/w. 34 of IPC and Sections 3 & 4 of MPID on executing PR Bond in the sum of Rs. 15,000/- with one or more solvent sureties in the like amount.
(c) The applicant shall attend the police station as and when called for.
(d) The applicant shall furnish his contact details including mobile number to the concerned Police Station. If there is any change in the contact details, applicant shall immediately inform the same to the concerned police station. 6.
