This is an Application for pre-arrest bail under section 438 of the Code of Criminal Procedure in connection with C.R. No.67 of 2021 registered with Poynad police station, District Raigad-Alibag for an offences punishable under section 420, 406, 467, 468 and 471 read with section 34 of the Indian Penal Code.
The learned APP submits that investigations into the crime are already complete and that a charge-sheet has been filed against the Applicant. He would further confirm that custodial interrogation of the Applicant would no longer be necessary. He however requests that Applicant be directed to attend the dates before the learned Judicial Magistrate in view of the fact that two other accused were absconding. katkam Page No.

His custodial interrogation is no longer necessary in view of filing of the charge-sheet as well as statement made by the learned APP. It appears that the Applicant has already deposited the amount of Rs.72,500/- in this Court. In that view of the matter, the Anticipatory Bail Application can be disposed of by making the interim order dated 23 December 2021 absolute.
I accordingly proceed to pass the following order:
O R D E R
i) Interim order dated 23 December 2021 is made absolute. ii) The amount of Rs.72,500/- deposited by the Applicant in this Court together with accrued interest thereon be transferred to the Court of Judicial Magistrate First Class, Alibag where the charge-sheet is filed against the Applicant.
With the above directions, the Anticipatory Bail Application is allowed and disposed of.
