Heard Shri Shashank Choudhary, the learned counsel for the applicant. None appears for respondent nos.2, 3 and 4, when called out. It is seen that Shri Ruchir Dholakia had been appearing on behalf of respondent nos.2, 3 and 4. avk 1/4

The order of acquittal is an appellate order. Respondent nos.2, 3 and 4 were found guilty by the learned Magistrate.

Leave granted.

The application be treated as 'Memo of Appeal' and be numbered accordingly.

Necessary amendment be carried out within a week. The appeal is admitted.

Issue notice to the respondents.

Respondent Nos.2, 3 and 4 shall execute a fresh bond in the sum of Rs.10,000/- each, before the trial court, within a period of four weeks from the service of notice upon them. avk 2/4

The appeal be listed for 'Final Hearing' in due course. Liberty to either of the parties to move the court for getting an early date for final hearing of the appeal fixed, after receipt of the record and proceedings.
