Since the applicant is facing accusations under Section 420 read with 34 of I.P.C., learned A.P.P. states that the Investigating Offcer shall issue notice under Section 41A of Cr.P.C. within 7 days.

Upon receipt of the notice, the applicant shall report to the Investigating Offcer within seven days thereafter. 2.

Upon his appearance, the Investigating Offcer shall follow the mandate set out under Section 41A of Cr.P.C. and M.M.Salgaonkar

2/2 916 ABA-3013-22.doc shall record reasons in writing, in case, he comes to the conclusion that the arrest is necessary. Before effecting the arrest for the purpose of custodial interrogation, he shall serve 72 hours notice to the applicant.
