1] Considering the offences levelled against the Applicant in CR No. 577/2022 which invoke offence under Section 420 read with 34 of the IPC and relevant provisions of Fertilizer Control Order, 1985 and Section 3 and 7 of the Essential Commodities Act, 1955, the learned APP states that the Investigating Officer shall issue notice under Section 41A of the Cr.P.C. within a period of one week from today. Upon receipt of the notice, the Applicant shall report to the Investigating Officer within a period of one week thereafter. Upon his presence, the Investigating Officer shall follow procedure prescribed under Section 41A of the Cr.P.C. and record reasons in case if he comes at a conclusion that custodial interrogation of the Applicant is very much necessary for completing the investigation.
