This is an application for anticipatory bail in C.R. No. 192 of 2022 registered with Haveli Police Station for ofences punishable under Sections 3, 4, 5, and 7 of the Immoral Trafc (Prevention) Act and Section 370 read with 34 of the Indian Penal Code.

The case of the prosecution is that raid was conducted on 02.09.2022 at Blue Berry Spa Destination Center Mall. It was revealed that the applicant is the owner of spa and prostitution activities are conducted at his instance. One of the victim was found at the spa. She disclosed that she was getting salary of Rs.15,000/-. It is alleged that under the

Learned advocate for the applicant submitted that the applicant has been falsely implicated in this case. He has no complicity in the crime. He was not conducting the spa. He has no connection with prostitution activities. He is willing to co-operate with the investigation. The statement of the victim under Section 164 of Cr.P.C. are not produced. 4.

Whereas learned APP pointed out investigation papers, statement of victim, accused and investigation conducted by police revealed complicity of the applicant. In the said statements it disclosed that the applicant has actively participated in the activities of this spa. At the instance of the applicant, the amount was being collected from the customers. Under garb of spa extra services were provided by charging extra amount.

Considering the complicity of the applicant no case for grant of anticipatory bail is made out.

ORDER

Criminal Anticipatory Bail Application No.3006 of 2022 is rejected and disposed of.
