2] With the assistance of learned APP, I have perused the order passed by the court below, rejecting the prayer for pre-arrest bail, so also contents in the FIR. As far as allegations against the Applicant are concerned, there is not specific role attributed to him in the FIR. As a 1/3
consequence, this Court ordered interim protection in favour of the Applicant on 3rd October, 2019. The present Applicant is protected by this Court for about two years. Though the Applicant is named as accomplice of the co-accused in the FIR, no specific role is attributed to him. Apart from above, it is not demonstrated as to how the Applicant is recipient of the amount involved in the crime, particularly when the FIR in categorical terms attributes default to co-accused Prathamesh More and his accomplice Kamlakar Dukhde. 3] In that view of the matter, interim protection ordered against the Applicant stands confirmed.
4] In the event of the arrest, the Applicant be enlarged on bail in C.R. No.473 of 2018 registered with Park Site Police Station for the offence punishable under Sections 406, 420, 465, 467, 468 read with Section 34 of the Indian Penal Code on furnishing P.R. Bond in the sum of Rs 20,000/- with one or two sureties in the like amount. The Applicant shall report to the Investigating Officer of Park Site Police Station in Crime No.473 of 2018 as and when called between 10.00 A.M. and 1.00 P.M. Applicant shall neither influence the witnesses in 2/3
any manner nor tamper with the evidence. Applicant shall attend the concerned Police Station as and when directed. 5] Application is accordingly disposed of.
