We have perused the order passed by the Division Bench of this Court on 19/12/2013 in Writ Petition No. 9112 of 2013, which was filed by the present petitioner - Dhanaji Malhari Kashid. Petitioner's grievance is that the respondents therein has again raised illegal construction. Petitioner has already filed Contempt Petition bearing Contempt Petition No. 528 of 2015.

In the facts, we observe that the petitioner may prosecute the remedy of the Contempt Petition. In case it is found that the petitioner requires to agitate on fresh issues, the same would

2/2 15-wp-1648-16 be looked into at an appropriate stage. Petitioner is also entitled to prosecute the alternate remedy available in law.

Keeping all issues on merits open, petition is disposed of.
