Heard the learned counsel for the parties.

These three petitions were filed by the petitioner for appointment of Arbitrator as per clause 70 of the General terms and conditions of contract.

As the respondents failed to appoint Arbitrator as per their notice dated 14.11.2014 in Arbitration Petition No.65 of 2014 and 66 of 2014 and notice dated 17.8.2014 in Arbitration Petition No.67 of Mohite 1/2

4 arp65-15, 66-15, 67-15.doc 2015, petitioners filed these petitions under section 11 of the Arbitration and Conciliation Act, 1996.

The learned counsel for the respondent submits that they have no objection to appoint Shri Sudesh Kumar Gupta, Chief Engineer (Q,S&C) as Arbitrator in the present proceeding.

Hence, by consent of both the parties, following order is passed:

a) Mr.Sudesh Kumar Gupta, Chief Engineer (Q,S&C), Standing Panel of Arbitrators, (Pune), having address as; CWE Pune Complex, General Cariappa Marg, Pune Camp, Pune 411001 is appointed as sole Arbitrator in all these three petitions.

b) Registry is directed to inform the learned Arbitrator about his appointment.

c) All the Petitions stand disposed of accordingly. (K.K.TATED, J.) Mohite 2/2
