Heard learned counsel for the Applicant.

The learned counsel for the Applicant submits that the Applicant has filed proceedings under the D.V. Act and for maintenance against the Respondent-Husband, which are pending at Nashik. The Respondent-Husband has filed Divorce Petition against the Applicant, which is pending in Family Court at Aurangabad.

The Applicant stays with her parents at Nashik. It is difficult for her to attend the Court date's at Aurangabad. Hence, requested to allow the Application.

Though the Respondent is served, none present for the Respondents. Hence I am deciding this Application on merit. 5.

The Applicant stays at Nashik, she seeks transfer of Divorce Petition filed by the Respondent at Aurangabad, Family Court. Considering the submissions of the learned counsel for the Applicant and the reasons mentioned in the Application, as well as it is settled principal of law convenience of the wife has to be considered at the time of the transfer of the Petition. 6.

In view of above, I pass following order.

ORDER

(i) The H.M. Petition No.A-261 of 2023 pending before Family Court at Aurangabad be transferred to Family Court at Nashik.

(ii) The Application is allowed and disposed of.
