Petitioner is present with his Advocate. Respondent No.2 is present with her Advocate. Parties are jointly requesting for quashing of the charge sheet which is under Section 376, 417 of the Indian Penal Code and under Section 3(1)(12) of the Scheduled Caste and Scheduled Tribes (Prevention) of Atrocities Act, 1989. The respondent No.2 has tendered affidavit in court giving no objection.

We have perused the report as alleged. It shows acquaintance since 2009 and consensual relationship between the parties. We are not making reference in more details to said FIR. Only to show their bonafides the parties have stated that they will pay reasonable amount as costs. - Page-1/2

Learned APP is present for respondent No.1 and is opposing intervention by this court.

As we find that nothing fruitful will come out in the matter, we are inclined to intervene. Subject to applicant and respondent No.2 paying a sum of Rs.50,000/- together to Police Welfare Fund within four weeks from today, we make the rule absolute in terns of prayer clause (a) ( SMT.
