The appellant was convicted for offence under Section 4 of the Protection of Children from Sexual Offences Act, 2012 and sentenced to suffer imprisonment for 7 years and fine of Rs.5,000/-.

Learned counsel for the appellant on instructions submitted that the appellant has undergone the sentence and he do not wish to pursue this appeal. The appeal may be disposed of as infructuous. It is submitted that the appellant has been released from jail after undergoing the sentence. 3.

Apeal-1300-2019.doc 10th January, 2022 it is stated that the appellant was in jail from 21st July, 2014 and he has undergone the sentence of imprisonment and released by the jail authorities of Nashik Road Central Prison. He has no objection for withdrawal of the appeal as he has already undergone the sentence imposed upon him. The Affidavit it taken on record and marked as 'X' for identification.

Considering the aforesaid circumstances, the appeal is disposed of as infructuous.
