At the outset, learned Counsel for the petitioner seeks leave to amend. Leave granted. Amendment to be carried out during the course of the day.

Heard learned Counsel for the petitioner and learned APP 1/3

for the State.

Only relief sought in the aforesaid petition reads as under; "(A)That by way of appropriate writ, order or direction honorable court may kindly direct the Respondent to decide upon the Intervention Application dated 26th September, 2019 in time bound manner probably within 15 days from the receipt of the Order of this Hon'ble Court."

The grievance of the learned Counsel for the petitioner is that an Intervention Application was filed by the petitioner in September, 2019 and that the said application filed below Exhibit - 116 in Special Case No. 2 of 2016, pending before the learned Special MPID Court, Vasai, has not been decided by the said Court, till date. It is, therefore, prayed that the direction be given to the learned Special MPID Court, Vasai, to decide the said Intervention Application (Exhibit - 116) filed in Special Case No. 2 of 2016, expeditiously. 5.

Learned APP has no objection.

Accordingly, we allow the aforesaid petition. The learned trial Judge, to decide the said Intervention Application filed below Exhibit - 116 in Special Case No. 2 of 2016, as expeditiously as possible, and in any event, within six weeks from the date of receipt of this order.

The petition is accordingly disposed of on the aforesaid terms.

We make it clear that we have not gone into the maintainability of the said Intervention Application and that all contentions of all parties are kept open.

All concerned to act on the authenticated copy of this order.
