In view of the earlier application being withdrawn on 12-09-2014 and by the said order my predecessor expedited the trial and without informing the said fact to the learned counsel for the applicant, the present application being filed, it is difficult to entertain it.

Needless to add the earlier application being withdrawn by obtaining the order of expediting the trial from the Court and there being 1/3

no change in the facts and circumstances qua material against applicant, this application does not survive.

However, learned counsel for the applicant having brought to the notice that the applicant was arrested on 24-07-2012 and every accused in custody has right of an early trial, this application is disposed of with direction to the learned Sessions Judge seized with this matter that saving just exception, frame the charge at the earliest and in any event within a period of six weeks from today. 4.

It is clarified that after such charge is framed the applicant would be at liberty to approach for bail in terms of the order passed earlier i.e. if the trial is not over within a period of eight months from the date of framing of charge.
