The report submitted by Police Inspector Ichalkaranji Police Station, dated 07-04-2016 states that the Proprietor of Respondent No.1 Baburao Bhausaheb Mirajkar, expired in an accident on 02-11-2015, at Kolhapur. The Respondent No.1 was the original accused in Summary Criminal Case No.661 of 2009 filed by the appellant herein. 2.

In view of the death of Respondent No.1-original accused, the complaint and/or Criminal proceedings as against him stands abated. In view of the same the appeal does not survive and is accordingly disposed of.
