After arguing for some time, learned counsel for the applicant, on instructions, prays for withdrawal of this application. He submits that the observations made by learned Additional Sessions Judge, Palghar in the order granting bail to the Respondent No.2 may not come in the way of the first informant/victim when the trial is decided. The request is reasonable.

13-appln-537-18 observations made by learned Additional Sessions Judge, Palghar in his order dated 14/08/2018 granting bail to the respondent No.2 were restricted for consideration of grant of bail only. The Trial Court shall decide the Trial independently on the basis of evidence led before it.
