This application is preferred by plaintiff for condonation of 3 days delay in filing First Appeal challenging the judgment and decree dated 2.9.2014 passed by Bombay City Civil Court, Mumbai in S.C.Suit No.1427 of 2011 dismissing plaintiff's suit.

Considering the submissions made by the learned counsel for the Applicant and the averments in Civil Application, I am satisfied that the Applicant has made out a case for allowing the Mohite 1/2

A) Civil Application is allowed in terms of prayer clause (a) which reads thus:

"(a) This Hon'ble Court be pleased to condone delay of 3 days in filing the Appeal."

B) Civil application stands disposed off accordingly.
