By this petition under Article 226 and 227 of the Constitution of India Petitioner is challenging the Judgment and Decree dated 16th September, 2015 passed by the Motor Accident Claims Tribunal, Satara below Exh.6 in Motor Accident Claim Petition No. 183 of 2014.

When this Court raised objection about maintainability of this Writ Petition, the learned Counsel for Petitioner submit that Petitioner has preferred application before the trial court about maintainability of Claim Petition itself and that was decided against him. Hence, Writ Petition is maintainable.

Bare reading of the order dated 16th September, 2015 passed by the Motor Accident Claims Tribunal, Satara shows that the Tribunal has passed decree in favour of the Respondents/Claimants for sum of Rs. 50,000/-.

As alternate efficacious remedy is available to the Petitioner in law, present Writ Petition stand rejected.
