The challenge in this petition under Article 226 of the Constitution of India, is to the following orders :- (i) Order-in-Original dated 29th July, 2010 passed by respondent no.3.
(ii) Order-in-Original dated 20th April, 2017 passed by respondent no.2; and (ii) Final Order dated 6th October, 2017 passed by Customs, Excise and Service Tax Appellate Tribunal (the Tribunal). 2.
At the very outset, Mr. Prabhakar, learned Counsel appearing for the petitioner submits that the issue arising herein stands concluded

It is an agreed position that there are no distinctions either in facts or in law which would warrant a different view.
