This is an Application filed under Section 438 of the Code of Criminal Procedure, 1973 by the aforesaid Applicant apprehending his arrest in Crime No. 427 of 2018 registered with the Kopar Khairane Police Station, Navi Mumbai for the offences punishable under Sections 353 and 332 and sections 129, 177, 134(A) and 134(B) of the Motor Vehicle Act.

The aforesaid crime was registered pursuant to the

first information report lodged by Mr. Mahesh Gaikwad, a traffic constable. He states that on 26.12.2018, while he was on patrolling duty, he had seen the Applicant riding a motor cycle without helmet. The first informant has alleged that when he stopped the Applicant and asked him to show his license and other documents, the Applicant tried to flee away from the spot without showing his documents and in the process, the motor cycle dashed against him resulting in grievous injury. 3.

By order dated 04.10.2019, this Court ( Coram : Revati Mohite Dere, J. ) had granted interim protection to the Applicant with a direction to report to the investigating officer on the dates specified in the order. Learned APP states that the Applicant has complied with the said condition and co-operated with the investigation. He further states that the presence of the Applicant is not required for the purpose of custodial interrogation.

Considering the said fact and also the nature of the allegations, the Application is allowed on the following terms and

conditions :- O R D E R (i) In the event of arrest of the Applicant in C. R. No. 427 of 2018 registered with the Kopar Khairane Police Station, Navi Mumbai, he be enlarged on bail on furnishing P. R. Bond in the sum of Rs. 10,000/- with one or two sureties in the like amount; (ii) The Applicant shall furnish his current address and mobile contact numbers and / or change of residence or mobile details, if any, to the investigating officer; (iii) The Applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

The Application stands disposed of.
