P.C.:- This is an Application under Section 439 of the Code of Criminal Procedure for bail in CR No. 123 of 2018 dated 4th May, 2018 registered with Mahatma Gandhi Chawk, Miraj Police Station , District Sangli under Sections 3, 4 and 5 of the Immoral Traffic (Prevention) Act, (PITA Act).

Heard the learned counsel appearing for the Applicant and the learned APP. Perused the charge sheet.

It is the prosecution case that, after the receipt of specific information from Shri. Ashwin John Rathod, Associate Director of "Freedom Firm Institution" a non Government Organization the police attached to Mahatma Gandhi Chowk Police Station, Miraj conducted 1/3

ssm 2 37-ba2550.18.doc raid at the residential premises of the Applicant. The said premises is owned by her mother Smt. Kashibai Kankanwadi. It is the allegation that, the Applicant was conducting the vocation of prostitution at her residential premises and was earning her livelihood from the income of the said vocation. After conducting raid, when the police made inquiry with the victim ladies, they informed that 50% of the amount earned by them, was being paid to the Applicant. That co-accused Mr. Salauddin Lashkar was acting as an agent in the said crime. During the course of investigation, the Applicant came to be arrested on 10th May, 2018 and after completion of investigation, the police have submitted charge sheet. As noted earlier, the allegation against the Applicant is that, she provided her residential premises for conducting the vocation of the prostitution to the victim ladies and was earning her livelihood from the said money.

The learned counsel appearing for the Applicant submitted that, there are no antecedents at the discredit of the Applicant. The Applicant is in jail since 10th May, 2018 and the police have already completed the investigation.

ssm 3 37-ba2550.18.doc In view of the above, Applicant can be released on bail. Hence, the following order.

a) The Applicant be released on bail in CR No. 123 of 2018 dated 4th May, 2018 registered with Mahatma Gandhi Chawk, Miraj Police Station, District Sangli on her furnishing PR bond of Rs.25,000/- with one or two solvent local sureties in the like amount.

b) After her release from Jail, the Applicant shall attend the Mahatma Gandhi Chawk, Miraj Police Station, District Sangli, on every first Monday of the month between 11.00 a.m. and 1.00 p.m.

c) The Applicant shall attend all the dates before the Trial Court unless precluded on medical reasons. d) The Applicant shall not tamper with the evidence and/or pressurize the prosecution witnesses.
