Civil Application No. 1 of 2023 is filed by the Applicant/Appellant seeking a condonation of delay of 922 days in filing the above Family Court Appeal.

When the matter was called out on 2nd February, 2024, none had appeared on behalf of the Applicant/Appellant. In these circumstances, we had placed the above matter today for dismissal.

Today also when the matter is called out, none appears on behalf of the Appellant/wife. It appears that the Appellant/wife is not interested in prosecuting the above Civil Application or the Appeal. In these circumstances, the above Civil Application is dismissed for want of prosecution. Since the Application seeking condonation of delay is itself dismissed, the above Appeal is also dismissed.

In view of dismissal of the above Appeal, nothing survives in Civil Application No. 2/2023 [seeking maintenance and permanent alimony] and the same is disposed of accordingly.
