The applicants are apprehending their arrest in Crime No. 241 of 2022 registered at Ashta police station, Sangli for the offence punishable under Section 498A, 323, 504, 506 read with 34 of Indian Penal Code.

The applicant No.1 is the husband of the complainant and applicant No.2 is her mother-in-law. According to the complainant, 1 / 3

the applicants ill-treated her on account of demand of money. According to her on many occasions she was assaulted, abused and humiliated.

I have heard the learned counsel for the applicants and learned APP for the respondent- State and perused the first information report (FIR).

Perusal of the FIR shows that the marriage of the applicant No.1 and the complainant took place in the year 2011. Almost all the incidents of alleged cruelty are of the year 2011 and 2012 whereas the complaint came to be lodged in the year 2022. Considering these facts and circumstances and as there is no need of custodial interrogation, I am inclined to release the applicants on anticipatory bail. Hence, the following order is passed:

O R D E R

(i) Application is allowed.

(ii) In the event of arrest of applicants in Crime No. 241 of 2022 registered at Ashta police station, Sangli for the offence punishable under Section 498A, 323, 504, 506 read with 34 of Indian Penal Code, they shall be released on bail on furnishing P.R. bond in the sum of Rs.25,000/- each with one or two sureties in the like amount.

(iii) The applicants shall attend concerned police station every alternate day for a period of two weeks from 27 October 2022 between 11 am to 2 pm and shall cooperate in the investigation.

(iv) The prosecution is at liberty to file application for cancellation of bail if the condition of attendance is breached. ( N.R. BORKAR, J. ) 3 / 3
