1) This is an application for relaxation of condition No.2 imposed upon the applicant while granting him bail by the learned Additional Sessions Judge, Palghar by its Order dated 2nd January 2016 in Bail Application No.274 of 2015. The said condition reads as under:
"Applicant shall be released on his executing P.R. Bond of Rs.30,000/- and on furnishing the solvent surety in the like amount". 2) The learned counsel for the applicant submitted that the applicant has been directed to be released on bail by an Order dated 2.1.2016, however, because of the said onerous condition the applicant is still languishing in jail. He submitted that the applicant is an ordinary resident of Ahmadabad, State of Gujrat and it is
Dond 2/2 APL.1293-2016.sxw very difficult for him to get solvent local surety from Mumbai, Thane or Palghar. He prayed that the said condition may be suitably modified in the interest of justice.
3) In view of the above, and the facts mentioned in the application, the condition No.2 imposed upon the applicant by an Order dated 2.1.2016 in Bail Application No.274 of 2015 is hereby modified and the applicant is permitted to furnish one or more solvent sureties from the City of Ahmadabad State of Gujarat.
