Heard learned Counsel for parties.

By this Civil Application, applicant is seeking restoration of First Appeal No.361 of 2002 which stands dismissed in view of conditional order dated 29.04.2014 passed by this Court.

The learned Counsel for the applicant submits that inadvertently it remain on their part to comply the order dated S.C. Magar 1/2
9.caf.3948.2014.doc 29.04.2014. He submits that applicant undertakes to comply the order dated 29.04.2014 within four weeks from today.

Considering the submissions made by learned Counsel for the applicant, averments made in Civil Application, I am satisfied that the applicant has made out case for allowing this Civil Application. Hence, following order :- a) First Appeal No.361 of 2002 is restored on file for hearing on its own merits.
b) Time to comply the order dated 29.04.2014 is extended till 30.06.2019, failing which Civil Application shall stand dismissed without reference to the Court.
c) Civil Application stands disposed of accordingly.
d) No order as to costs.
