The Petitioner's caste claim is pending with the Caste Scrutiny Committee since 2008. Therefore, the present petition is filed as the caste claim is not yet decided. By order dated 31 October, 2014 one year period was granted to the Petitioner by the Maharashtra Administrative Tribunal to produce the Caste Validity Certificate. However, as the same is not yet decided, the apprehension of termination of service just cannot be ruled out. Therefore, at this stage, we are inclined to direct not to take coercive steps against the Petitioner for want of Caste Validity Certificate until the same is decided by the Caste Scrutiny Committee.

We are informed that the matter has been earlier heard and Petitioner was also heard on 4th September, 2015 by the Caste Scrutiny Committee. Therefore, till the final decision, no coercive steps be taken against the Petitioner for want of Caste Certificate. 3.

The Caste Scrutiny Committee to decide the cast claim as early as possible, preferably within two months. 4.

The Petition is accordingly disposed of.

No order as to costs.
