2/2 6-aba-1817-1827-17.doc instructions, from the investigating officer who is present in Court submitted that the investigation is going on and at least till today they have not collected any incriminating evidence. During the course of investigation, if any incriminating evidence is collected against the applicants, and, if the investigating officer finds that the applicants' custody is necessary or their presence is necessary for interrogation at the police station, the investigating officer shall give 72 hours notice in advance to the applicants. In view of this, the applications are disposed of by passing the following order:

:: O R D E R ::

(i) In the event, the notice as stated above, is given to the applicants by the investigating officer, than the applicants will be at liberty to prefer fresh application before the Sessions Court;

(ii) In the event, such an application is preferred, the Sessions Court shall deal with the said without being influenced by this order.
