After hearing the matter for some time, the learned Counsel for the parties are agreed to the following order being passed:

O R D E R

(i) The order dated 19 September 2016 upon the consent terms is set aside and the consent terms shall not be acted upon. (ii) The Appeal No.4 of 2014 shall stand revived. The Appeal shall be considered afresh and disposed of without being influenced by the impugned order.

(iii) The Respondent No.4/original Appellant is permitted to add the Petitioner as a party-Respondent to the Appeal. The consequential amendments are also allowed. The School Tribunal shall, accordingly, permit the Respondent No.4/original Uday.P.Kambli 1/2

2/2 wp-1918-17.doc Appellant to carry out the amendment to the Appeal. (iv) The newly added Respondent (Petitioner herein) shall be entitled to file a Written Statement/Reply to the Appeal. (v) All contentions of the parties are kept open. 2.

On the request of the learned Counsel for the Respondent No.4, the presence of the Respondent No.4 in the Court is recorded. 3.
