This is an application fled under Section 438 of the Code of Criminal Procedure, 1973 for grant of anticipatory bail. 2.

The applicant is apprehending his arrest in Crime No.396 of 2022 registered at Kurudwadi Police Station for the ofence punishable under Section 306 r/w. 34 of Indian Penal Code. 3.

It is the case of the prosecution that there was some fnancial transaction between the deceased and accused in the present crime. The accused were harassing him and were asking him to return their money. It is alleged that due to the said harassment on 09 August, 2022, the deceased committed suicide by consuming poison.

I have heard the learned Counsel for the applicant and the learned APP for the State.

I have perused the First Information Report. No specifc overt act is attributed to the present applicant. The general allegations are made against all the accused. It appears that nothing is to be recovered from the applicant and therefore, his custodial interrogation is not necessary. Considering these facts and circumstances, I am inclined to grant anticipatory bail to the present applicant. Hence, the following order:

ORDER

(i) Application is allowed.

(ii) In the event of arrest of applicant in connection with Crime No.396 of 2022 registered at Kurduwadi Police Station for the ofence punishable under Section 306 r/w. 34 of IPC, he shall be released on bail on furnishing P.R. Bond in the sum of Rs.25,000/- with one surety in the like amount. (iii) The applicant shall attend the concerned police station from 12 November 2022 to 14 November 2022 between 11.00 a.m. to 02.00 p.m. and shall co-operate in the investigation.
