The Learned Counsel for the Petitioner Mr. P. B. Bhargude after arguing for some time on instructions of the Petitioner No.1 who is personally present in Court seeks withdrawal of the above Petition so as to file an application before the Joint Charity Commissioner for the Appeal in question being Appeal No.35 of 2013 and the Application being No.3 of 2014 for condonation of delay to be heard together and in the event the application for condonation of delay being No.3 of 2014 is allowed, then both the Appeals to be heard together. The Petition is accordingly allowed to be withdrawn. Needless to state that if any such application is filed by the Petitioner, the Joint Charity Commissioner would consider the same on its own merits and in accordance with law.
