After this Writ Petition was heard for sometime, we enquired from Shri Deokar, appearing on behalf of the Management as to why the proposal has not been forwarded by the Management so as to enable the petitioner to claim higher pay scale. On instructions, Shri Deokar says that the Management is not averse to forwarding such proposal even now. It will forward such proposal as expeditiously as possible and, in any event, within a period of four weeks from today. 1/2

Once the proposal is so forwarded, it is entirely for respondent Nos. 2 and 3 to determine the matter in terms of existing policy and hold whether the petitioner is entitled or otherwise to the higher pay scales / UGC scales. In the event the petitioner is held to be eligible, then, all the benefits, including differential salary shall be released in favour of the petitioner through the Management (fourth respondent herein) within a period of three months from the date the decision is taken in favour of the petitioner.

The Writ Petition is disposed of by clarifying that despite detailed affidavits being placed on record, this Court has not examined the merits of the rival contentions. (M.S. KARNIK, J.) (S.C. DHARMADHIKARI, J.) 2/2
