Heard learned counsel for the Applicant and the learned APP for the Respondent No.1 - State.

By this Application, the Applicant seeks the following prayer :- "4(a) The Applicant be granted permission to travel Ain EL Sokhna, Egypt from 7th November, 2016 to 29th November, 2016, 1st December, 2016 to 31st December, 2016 to Dubai, 2nd January, 2017 till 30th January, 2017 to London, 2nd February, 2017 to 4th
March, 2017 to Australia and 8th March to 17th March, 2017 to Dubai."

Learned counsel for the Applicant submits that the Applicant is working as a CEO with DP WORLD & is the Director of three Companies, namely NSICT, CRRS & NSIFT, Navasheva (NSICT). She submits that the Applicant is required to travel abroad for business purpose on and of. She submits that the Applicant was permitted to travel abroad by this Court vide order dated 25.08.2016 on certain conditions. She further submits that filing of charge-sheet has been stayed by the Division Bench of this Court. She further submits that the Applicant has abided by the terms & conditions imposed by this Court vide order dated 25.08.2016 when he was granted permission to travel abroad.

Learned APP does not dispute the fact that the Division Bench has directed not to file
charge-sheet against the Applicant and that the same is pending before the Division Bench. He submits that the Applicant be permitted to travel abroad on the same conditions as were imposed by this Court earlier vide Order dated 25.08.2016.

It is not in dispute that the Division Bench is seized of the matter and has given direction to the investigating officer, not to file charge-sheet in the Applicant's case. It also appears that the Applicant's family resides in Mumbai and that he has two children studying in School and as such, the possibility of the Applicant's absconding is bleak. It also appears that the Applicant has complied with the earlier order dated 25.08.2016 permitting him to travel abroad on certain conditions.

Considering the aforesaid, the Application is allowed in terms of prayer clause (a). The Applicant shall furnish his travel itinerary to the concerned/incharge Senior Police Inspector, C.B.D. Belapur Police Station, Navi Mumbai, containing details of the places he will be staying i. e. addresses and telephone numbers, before every travel, before leaving India. The Applicant shall inform the concerned/incharge Senior Police Inspector, C.B.D. Belapur Police Station, Navi Mumbai every time he returns back to India about his return. The Applicant shall file an undertaking in this Court stating therein that he will abide by the aforesaid terms & conditions imposed by this Court. The undertaking to be filed by the Applicant in this Court, within one week from today.
