Heard leaned counsel for the applicant and learned APP.

This is an application for pre-arrest bail in respect of FIR No.873 of 2022 dated 30/08/2022 registered with Waliv Police Station, Vasai, for the offence punishable under Sections 7 and 9 of the Essential Commodities Act, 1955 and Sections 420, 465, 467, 468, 471 read with Section 34 of the Indian Penal Code, 1860.

After the matter is argued for some time, the learned APP invited my attention to the order dated 18/10/2022

25.aba.3044-22.doc passed by this Court in Anticipatory Bail Application No.2917 of 2022. By this order the application of the Manger of the godown of which the present applicant is the owner was not entertained. After expressing my disinclination to entertain the present application, learned counsel for the applicant submitted that the applicant be granted some time to surrender himself. Statement is accepted. The applicant to surrender before the jurisdictional Magistrate within a period of two weeks from today when he may apply for regular bail.

Learned APP has made a statement on instructions that Kamlesh Damji Mithiya has been already arrayed as an accused and the Investigating Officer is proceeding ahead with the investigation in this matter.

Subject to what is stated hereinabove, the application stands rejected.
