After this petition was heard for some time, Mr. Malpathak, learned counsel for the Petitioner seeks leave to withdraw this petition to approach the Trial Court by moving a necessary application seeking clarification/review of the judgment and decree dated 31.07.2014. 2.

Petition is allowed to be withdrawn with liberty as prayed for. 3.

Needless to observe that in the meantime, the time spend by the petitioner in bonafide pursuing the execution proceeding and this writ petition shall be taken into consideration by the learned Trial Judge in any application which may be filed by the Petitioner which be filed within two weeks from today.

This petition is disposed of in the above terms. No costs. 5.

All contentions of the parties on merits are expressly kept open.
