Heard the learned advocate for the Applicant/accused no.1 in both Applications.

I have perused the record and proceedings.

It is seen that the Applicant/accused no.1 is charged with serious offences. The evidence of the prosecutrix has been recorded by the learned Trial Court. I am informed that now the matter is posted for recording the evidence of the other witnesses. Learned APP, on instructions, submits that the prosecution is proposing to examine 06 more witnesses.

The learned advocate for the Applicant/accused no.1 submits that since the evidence of the first informant has been recorded, the accused may be released on bail.

The copy of the deposition of the witnesses has been brought to my notice. I have gone through the same. In my view, instead of granting bail to the Applicant/accused, it would be in the fitness of things to expedite the hearing of the trial.

Accordingly, the Bail Applications are rejected. Hearing of the trial is expedited. The learned Additional Sessions Judge, Dindoshi, Mumbai shall dispose of the Sessions Case No.246/2018 on or before 30/01/2024.

Both Bail Applications along with Interim Application stand disposed of in above terms.
