This is the third bail application preferred by the applicant. The first bail application of the applicant was rejected on merits by this Court (Coram:Abhay M. Thipsay, J.) vide order dated 9th April, 2013, passed in Criminal Bail Application No.1950 of 2012. The second bail application
2/2 29-ba.2220.2016.doc of the applicant was dismissed as withdrawn by this Court (Coram:U.V.Bakre, J.) vide order dated 29th October, 2013, passed in Criminal Bail Application No.1652 of 2013.

Learned APP states that the applicant is refusing to sign the charge and hence the learned trial Judge has not been able to commence with the case. Passage of time cannot be said to be change of circumstance, considering the fact that the applicant himself is responsible for the delay caused in commencing the trial.

Hence, the Application is rejected and is disposed of as such. However, the trial of the applicant is expedited. (REVATI MOHITE DERE, J.)
