Heard learned counsel for the petitioner and learned counsel for respondent No.3 as well as learned APP for the State. 2.
Counsel appearing for the petitioner brought to our notice a communication made by Mr.Arun Valture, Assistant Commissioner of Police, Vashi region, Vashi on 15th April, 2015 addressed to the petitioner. He has informed the petitioner therein that an inquiry was initiated on his complaint dated 5th October, 2015 and 21st October, 2015 by the Assistant Commissioner of Police. The petitioner is called upon to remain present on 18th April, 2016 at about 5.00 p.m. in the office of the Assistant Commissioner 1/2
25) wp4329-15 of Police, Navi Mumbai.

Counsel submits that on the same date i.e. 18th April, 2016 the petitioner addressed a communication to the Assistant Commissioner of Police stating that the present petition was pending before this Court and hence he prayed for postponement of the date of hearing. Counsel, on instructions from the petitioner submits that the petitioner is willing to appear before the Assistant Commissioner of Police, Vashi on Monday, 9th May, 2016 at 11.00 a.m.

We direct that the inquiry shall thereafter start in respect of the allegations made by the petitioner against respondent No.3 herein. We further direct that the inquiry shall be completed within four weeks and the decision of the inquiry shall be communicated to the petitioner. It is clarified that we have not expressed any opinion on the allegations made by the petitioner. The petition is disposed of.
