Heard. This petition is filed for quashing the FIR bearing No.38 of 2012 dated 2nd April 2012 registered with Economic Offences Wing at the instance of Respondent No.2 for the offence punishable under sections 465, 467, 468, 471, 420 read with 120-B of the Indian Penal Code, 1860. In short, the allegation made against the Petitioner is that the Petitioner has secured cash credit facility of Rs.6 crores from Respondent No.2-bank by submitting forged documents. We have perused the FIR. Perusal of the same does prima facie disclose the commission of cognizable offence under the above provisions. The FIR is still under investigation. In the light of this fact situation, we are not inclined to consider the prayers made in patilsr 1 / 2

the application. Application is, therefore, dismissed. 2.

It is clarified that observations made hereinabove are for the limited purposes of disposal of the instant application. Courts below shall not be influenced in any manner by these observations.
