This is an Application under Section 439 of Cr.P.C. for bail in C.R. No.194/2017 dated 31.07.2017 registered with Malshiras Police Station, District Solapur for the offences punishable under Sections 306, 498-A read with Section 34 of the Indian Penal Code.

The Applicant is husband of Smt. Rajashree (deceased). It is the case of the prosecution that the marriage between the Applicant and deceased Smt. Rajashree was performed on 17.2.2010 and out of the said wedlock there are two children. That, the Applicant along with his parents and other family members use to harrass and torture deceased on the ground that, she was unable to perform household work properly and that she was not mentally fit. That due to the said constant harassment and torture, Smt. Rajashree (deceased) committed 1/3
suicide on 31.7.2017 in the well situated in the agricultural field. During the course of investigation, Applicant came to be arrested on 31.7.2017 and after completion of investigation police have submitted charge sheet. 3.
Perused the record.
The record indicates that on the date of incident i.e. on 31.7.2017, the witnesses saw the deceased going to the agricultural field at about 10.00 a.m. and thereafter, nobody noticed her. It is during the course of search by the Applicant his family members and the witnesses, the dead body of Smt. Rajashree was found floating in the well situated in the agricultural field. On a query put up by this Court, the learned APP on instructions of the Investigating Officer submitting that there is no parapet wall to the said well. 4.
In view thereof, the Applicant can be released on bail. Hence the following order:
i) The Applicant be released on bail in C.R. No.194/2017 dated 31.07.2017 registered with Malshiras Police Station, District Solapur on his furnishing PR bond of Rs.25,000/- with one or two solvent local sureties in the like amount.
ii) After his release from jail, the Applicant shall attend the Malshiras Police Station, District Solapur once in month i.e. on every 1st Monday of the month between 10.00 a.m. to 01.00 p.m. till the conclusion of trial. iii) The Applicant shall also attend all the dates before the Trial Court. 2/3
iv) The Applicant shall not tamper with the evidence and/or pressurize or threaten the prosecution witnesses.
