Heard Mr.Sanjiv Sawant, learned counsel for the applicant at length.

By this Application under Section 115 of the Code of Civil Procedure, 1908, (for short, 'C.P.C.'), the applicant has challenged the Judgment and order dated 18.8.2015 passed by the learned Jt. Civil Judge, Senior Division, Pune below Exhibit 30 in Special Civil Suit No.1175 of 2014. By that order, the learned trial Judge rejected the application made by the applicant under Order VII, Rule 11 (a) and (d) of C.P.C.

Mr. Sawant states that the applicant is present in the Court. After arguing the Application for some time and after obtaining instructions from the applicant, Mr. Sawant does not press this Application and submits that all contentions that are available to the defendant in the main suit may be kept open.

In view thereof, on the motion made by Mr. Sawant, Application is disposed of as not pressed. All contentions of the parties on merits are expressly kept open. Order accordingly. (R.G.KETKAR, J.)
